1. General Provisions

 

Romy Collé Jewelery – Provider and owner of the website  www.romycolle.com

Romy Collé Jewelery is registered with the Luxembourg Trade and Companies Register under number A40710, with registered office at 54 Avenue de la Gare, L-4873 Lamadelaine.

Customer is any natural person of legal age who has the necessary legal capacity to place and pay for an order.

The design of all products is specified by ROMY COLLÉ JEWELERY. The packaging and other accessories are not considered products.

A personalized product is created when a change is requested and specified by the customer. This means that every change requested by the customer in one or more product features or the request for a personal inscription results in this product becoming a personalized product.

Products delivered:

The detailed description for the delivered product is made after its manufacture according to its actual and accurate characteristics.

Deviations in relation to the weight and/or size of the gemstones described on the order form, if they are not diamonds, may be 10%.

All differences between the detailed description of the delivered product and the product description on the order form, which are within the above deviations, do not lead to a change in the price of the delivered product.

The images of the products are shown for illustrative purposes only. Product measurements depend on the size chosen and are accurately stated in their descriptions.          

The actual colors and their intensity may differ from the illustrations, as each screen has different display properties and a standard setting is not possible.

 

Claims for damages against Romy Collé Jewelery cannot be asserted if the images shown on the website deviate from the delivered products.

These general terms and conditions apply to any purchase made from Romy Collé Jewellery. Each order confirmed by the customer constitutes an irrevocable acceptance of these general terms and conditions by the customer. It is equivalent to a handwritten signed order and cannot be contested again. No deviation from these general terms and conditions is permitted unless expressly agreed in writing. The provisions that are not affected by the deviation remain fully valid.     

These general terms and conditions can be changed at any time. The general terms and conditions applicable to an order are those in force on the website at the time the order is confirmed.                                                

2nd prize

 

Product prices are in euros including all taxes. These prices apply to all orders to the countries of the European Union.

The product prices can change at any time due to fluctuations in the price of raw materials (precious metals and gemstones).

The ones on the site  www.romycolle.com  The prices indicated are considered final at the time of order confirmation and apply only to the selected product. 

If you want to change the product, such as changing the ring size, the product is made to order. Thus, the stated price for the product is not valid.                                                

 

3rd order

 

In order to place an order, the order must be confirmed by the customer. With the order confirmation, the customer declares:                        

  - Be at least 18 years of age, have the necessary legal capacity to place and pay for an order and act strictly for personal needs.

-to have read and accepted these general terms and conditions.

Romy Collé Jewelery can only execute the order after receipt of the total amount of the order. After receipt of the total amount, the customer is informed that his order is being processed.

 

An order for which the payment of the amount is still outstanding remains valid for a period of seven days. After this period of seven days, this order will be considered discontinued and will be cancelled. If the customer still wants to order the product(s) in question and if the amount to be paid is received after the above deadline, the customer must confirm a new order. If, as a result of a price change, the total amount of the new order is higher than the amount already paid for the canceled order, the customer must pay this difference, even if it concerns one or more identical products. In the opposite case, the difference will be refunded to him.

If an order is found to have errors in description or price, that order may only be processed after the errors found have been corrected. In this case, the erroneous order will be canceled and the customer will be offered the option of confirming a new order or having the full amount of the canceled order refunded.

 

An order can be changed or canceled by the customer at any time before shipment.

Once an order has been shipped, the provisions of Article 6 of these General Terms and Conditions - RETURNS AND REFUNDS apply. Any change to an order is only possible by canceling the current order and confirming a new order.

An order with personalized products can only be changed or canceled by the customer before the start of processing. Once an order has been processed, the personalized products associated with the order can no longer be changed or cancelled. The non-customized products can be modified or canceled before the order is shipped.

Romy Collé Jewelery also reserves the right to refuse or cancel an order, in whole or in part, for valid reasons, in particular in the event of the failure of one of its suppliers or in the event of force majeure, but also in the event of a payment problem, a foreseeable problem in terms of delivery, a abnormal or maliciously placed order. In this case, the customer will be notified and the full amount for the rejected or canceled order will be refunded.                                                

4. Payment

 

Terms of payment:

All orders are to be paid for by bank transfer or Pay-Pal. The bank details are given on the order forms. The order number must always be given with every bank transfer in connection with this order.      

 

5. Delivery

 

The order will be sent to the delivery address specified by the customer. Romy Collé Jewelery cannot be held responsible for customer input errors or their possible consequences, such as delay or wrong delivery. In these cases, the costs incurred for a possible return are to be borne by the customer.

The customer has to do everything to ensure that the order can be received. If the delivery cannot be delivered to the customer for reasons for which he is responsible (three unsuccessful delivery attempts, exceeding the deadline for collecting a package after notification of non-delivery), the order will be returned by the transport company to Romy Collé Jewelery and stored at the premises of Romy Collé Jewelery, made available to the customer. The order can be sent again at the customer's request after payment of the return costs.                        

The deadlines for the manufacture of the products are indicative.

The delivery time for an order may not exceed 4 weeks from the date of receipt of full payment for the order by Romy Collé Jewellery. After this period, the customer can, if he wishes, grant Romy Collé Jewelery an additional period or cancel the order.

Delivery is deemed to have taken place on the day it is first handed over to the delivery address indicated by the customer.

                        

acceptance of the order

Upon receipt, the customer must check the condition and compliance of the delivered products with the order. He must confirm acceptance of the delivery by signing the delivery note provided by the transport company. Further claims in connection with the condition of the delivered products will not be accepted, since the condition of the products is deemed to have been checked by signing the delivery note.

If, upon delivery, the external appearance of the package is not perfect, the customer may open the package in the presence of the carrier to check the condition of the products. If the products are damaged as a result of transportation, the customer must refuse the damaged package and write “rejected due to damage” on the delivery note.

In the event that the customer is not the recipient of the order, he must ensure that the recipient of the order has been made aware of the provisions of these general terms and conditions relating to the procedure for receiving packages. 

The transfer of title to the products takes place upon full payment of the price.

The transfer of risk to the products takes place upon delivery of the products.

 

6. Returns and Refunds

 

Statutory right of withdrawal

You (the consumer) have the right to withdraw from the purchase contract within fourteen days without giving any reason and without penalty. Exception: according to Article 55 §4b of the Luxembourg law, the consumer cannot exercise his right of withdrawal under §1 in the case of contracts for the supply of products that have been manufactured to the specific specifications of the consumer or are clearly personalised.

The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods. To exercise your right of withdrawal, you must inform us (Romy Collé Jewellery, 54 Avenue de la Gare, L-4873 Lamadelaine, represented by Romy Collé, tel.: +352 691 61 41 62, e-mail: info@romycolle.com), by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract.

To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired.        

Non-compliant products and visible defects

If the product delivered is not compliant or has visible manufacturing defects, the customer has a period of 7 days from the date of receipt of the product to return it.

  The conformity of the delivered products will be determined on the basis of the provisions of Article 1.1 of these general terms and conditions relating to the delivered products.

Romy Collé Jewelery undertakes, at its sole discretion, to repair, replace or refund, free of charge, any defective or non-conforming product.                    

Return Policy

In order to exercise the right of return, the customer must meet the following conditions:                       

-The returned product must be in its original condition and must not show any signs of wear and tear. The label and/or seal affixed to the piece of jewelry, proving that the product has not been used, must be intact.

-The jewelry must be returned without exception with all its accompanying elements (packaging, accessories, certificates, leaflets, original invoice), all of which must be in perfect condition.

return of the product

The product that is the subject of the return must be returned to Romy Collé Jewelery's registered office, 54 Avenue de la Gare, L-4873 Lamadelaine.

Romy Collé Jewelery cannot be held responsible for any damage to the returned product, accessories or packaging, including theft or loss.

refund

Upon receipt of the returned product, it will be checked by Romy Collé Jewelery specialists. Verification is based on high-resolution images taken prior to shipment. After verifying the conformity of the returned product, which includes the absence of signs of wear and tear and any sign of tampering or alteration, and provided that the product meets the requirements for return, Romy Collé Jewelery will refund the amount of this order in front.

                        

The refund will be made within 30 (thirty) days of receipt of the returned product, by bank transfer to the bank account held in the name of the customer who placed the order. Transfer to a bank account held in the name of someone other than the person who placed the order is not possible.

return shipping costs

If a product is returned for a refund without reason, the customer is responsible for the return shipping costs.

If a returned product does not meet the conditions required for return, no refund will be made. The product in question remains the property of the customer and will be returned to him after payment of the return shipping costs.                                             

7. Guarantee

 

Hidden Defects

All products are guaranteed for 2 years against all hidden defects. 

Romy Collé Jewelley undertakes, at its sole discretion, to repair or refund any defective product free of charge. In this case, Romy Collé Jewelery will cover all costs including shipping costs.

The guarantee cannot be granted if the defect reported by the customer is due to: 

-normal wear and tear or normal aging of the product                       

-abnormal use or improper use of the product

-Damage caused by negligence

-accidental damage

- deliberately caused damage

-Damage caused by improper care or lack of care

- Modifications or repairs of the product by an unauthorized third party

 

care service

Once a year, Romy Collé Jewelery offers a free maintenance service for all its jewellery, which includes cleaning, checking the setting of the gemstones, polishing and restoring the texture.

  The customer must bear the costs incurred in sending the products back to Romy Collé Jewelery to carry out the care.                      

Excluded Product Costs

For products that are not covered by the guarantee but that require repair, an estimate will be made to the customer before any intervention. Regardless of whether the customer accepts or rejects the estimate, the cost of returning the product will be charged to the customer and the product will only be sent to him after these costs have been paid.                       

8. Invoice

 

All Romy Collé products are accompanied by an invoice with a description and one or more photos (value over €500) of each product.                       

9. Jurisdiction

 

These general terms and conditions are governed by Luxembourg law. In the event of a dispute, only the courts of Luxembourg will have jurisdiction.  

 

10. Miscellaneous

 

If for any reason any provision of these Terms and Conditions is held to be unlawful, void or unenforceable and it is not possible by operation of law to supersede it by an appropriate provision of similar effect (a process which the parties may henceforth permitted to seek any jurisdiction dealing with the dispute in question, to the extent permitted by applicable law). This provision is therefore considered severable from the General Terms and Conditions and does not affect the validity and applicability of the remaining provisions, to the extent possible under the provisions of the applicable law.

The unenforceability, nullity or ineffectiveness of any provision of these general terms and conditions shall in no case render the remaining provisions of these general terms and conditions unenforceable, null or ineffective. If the unenforceability, nullity or invalidity of a provision is beyond doubt, that provision will be deemed unwritten.

Unless expressly stated otherwise, the fact that performance of an obligation has not been required or the fact that a penalty has not been imposed shall in no way constitute a waiver of any right in this regard.
